Terms & Conditions
These terms apply to all My BioHealth services, packages and memberships. By booking a service, purchasing a package, or subscribing to a membership, you confirm that you have read, understood and accepted these Terms & Conditions.
1. Booking & usage conditions
All sessions must be pre booked and are subject to availability. Appointments can be booked through our online platform or in person.
Limited services, such as those included once or twice per month, must be used within the billing month and do not roll over.
Unlimited services are subject to fair use, and may be monitored for overuse or misuse.
Membership services may not be shared with or transferred to another person.
2. Cancellations & no shows
Appointments must be cancelled or rescheduled at least 24 hours in advance.
Missed appointments and late cancellations for limited services will be counted as used.
Repeated no shows may result in booking restrictions or temporary suspension of privileges.
3. Packages
Packages expire 3 months from the date of purchase.
Sessions that are booked and missed, or cancelled with less than 24 hours notice, are forfeited.
4. Billing & payments
Service and package payments are processed securely via Fresha at the time of booking. The Recovery Blueprint fee is paid securely via Square.
The $99 Recovery Blueprint fee is redeemable, in full, as a credit toward the cost of your first Recovery Pathway program if you book one within 3 months of your Blueprint session. It has no cash value, cannot be redeemed for individual drop in sessions or packages, and is forfeited if unused within that period.
Memberships are billed monthly by direct debit on your nominated date.
Failed payments incur a $15 late fee and must be resolved within 7 days.
Members are responsible for keeping valid and up to date payment details on file.
Clinical credit must be used within the same billing period and cannot be carried forward.
5. Membership freeze & cancellation
Members may freeze their membership once per calendar year for up to one month, with a minimum of 30 days written notice.
Cancellations must be submitted in writing at least 30 days before the next billing cycle.
No refunds or credits are provided for unused services on cancellation.
6. Consultation & safety
A wellness consultation is required before your first session to assess your suitability for our services.
Each service has specific contraindications, which will be discussed with you during your consultation.
Services may be refused where they are medically inappropriate or unsafe.
7. Health disclaimer
Our therapies are wellness services and do not replace medical advice, diagnosis or treatment. Results vary between individuals. Clients must disclose relevant health conditions during screening. Some therapies, including Hyperbaric Oxygen Therapy, are not suitable for everyone and may require GP clearance.
Clients participate in wellness therapies at their own informed risk, and acknowledge the physical and biological nature of certain services.
8. Privacy & confidentiality
All personal, medical and booking information is stored securely and handled in accordance with Australian privacy law.
Treatment areas remain private. Only authorised staff are permitted during sessions unless otherwise agreed with you.
9. Service modifications
My BioHealth reserves the right to update pricing, service access or policy terms with a minimum of 30 days notice.
10. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (or any other applicable law) that cannot lawfully be excluded, restricted or modified. Our services are provided with the guarantees that cannot be excluded under the Australian Consumer Law.
To the maximum extent permitted by law, and subject to the paragraph above, My BioHealth's total liability arising out of or in connection with any service, howsoever arising (including in contract, tort or under statute), is limited, at our option, to resupplying the relevant service or refunding the amount you paid for that specific service.
To the maximum extent permitted by law, My BioHealth is not liable for any indirect, special or consequential loss, or for any loss arising from a client's failure to disclose relevant health information, failure to follow pre or post session guidance, or from a pre existing medical condition not disclosed at screening.
Nothing in this clause limits liability for death or personal injury caused by negligence where such limitation is not permitted by law.
11. Governing law
These terms are governed by the laws of Victoria, Australia.
